BILLINGS, Mont. (AP) — Activists want a Montana judge punished over his comments that a 14-year-old rape victim was "older than her chronological age," as the former teacher who raped her is set to be released this week.

Stacey Rambold, who admitted raping 14-year-old Cherice Moralez in 2007, finished his 30-day term at the Montana State Prison in Deer Lodge on Thursday morning. Moralez, who at the time was a student at the high school where Rambold taught, committed suicide in 2010.

The Montana Supreme Court has blocked a judge from resentencing a former teacher who got just 30 days in prison for raping a 14-year-old student.

Judge G. Todd Baugh is now saying that his original sentence of a former Billings high school teacher who raped a 14 year-old girl might be illegal. According to the Billings Gazette a new hearing has been ordered by Yellowstone County District Court Judge G. Todd Baugh to assess the legality of his original sentence.

(AP) — A former Billings Senior High School teacher who pleaded guilty to raping a 14-year-old student who later committed suicide has been sentenced to 30 days in jail by a judge who said the victim was "older than her chronological age" and "as much in control of the situation" as the teacher.
