An attorney is appealing a plan by U.S. immigration authorities to deport a Mexican man just months after he settled a lawsuit over claims that he was raped while previously in federal custody in a Montana jail.  The petition with the 9th Circuit Court of Appeals was filed Wednesday night on behalf of Audemio Ramirez, who was arrested earlier in the day.  He said he was raped in 2013 while in custody in Jefferson County after officials determined he was in the country illegally.
